The Mombasa Municipal Council has challenged a major port expansion and dredging project, reports AllAfrica.
The council had instituted a criminal suit against the Kenya Ports Authority for failing to comply with the requisition. They argued that on April 12 Ndua was served with the physical planning notice by the council requiring him to stop development work of berth 19 to 22 and dredging of the habour within seven days.
Last week, the Kenya Ports Authority also moved to the High Court and filed a certificate of urgency, seeking to be granted leave to apply for an order to quash the decision contained in the council’s enforcement notice dated April 9th 2012.
Justice Richard Mwongo also granted leave for the Kenya Ports Authority to seek orders prohibiting the council from what it termed as illegally exercising any powers or instituting any criminal proceedings against the Kenya Ports Authority, or any of its directors, staff of employees.
