USA: District Judge Rules in Favor of NCR and Appleton Papers

According to greenbaypressgazette.com, NCR Corp. and Appleton Papers Inc. will not have to pay for the cleanup of PCBs from Little Lake Butte des Morts and southern portions of the lower Fox River, a federal judge ruled this week.

U.S. District Judge William Griesbach of Green Bay issued the ruling based on testimony he heard in February during a seven-day bench trial.

The two companies won their argument that they can’t be held solely responsible, especially upstream on the Fox, for discharging toxic polychlorinated biphenyls into the river in the 1950s and 1960s.
