The U.S. Seventh Circuit Court of Appeals on Friday rejected NCR’s claim that it already has done more than its fair share of the Fox River cleanup.
According to greenbaypressgazette.com, the U.S. District Judge William Griesbach of Green Bay in May ordered NCR to remove and clean a minimum of 660,000 cubic yards of sediment this summer from the Fox River.
Dredging work has been ongoing this summer, but NCR appealed that ruling and, after being denied a temporary stay of execution pending appeal, also appealed the denial.
The corporation lost that secondary appeal in May and lost the overall appeal this week when the Seventh Circuit Court rejected its argument that cleanup costs could reasonably be divided among paper companies along the Fox River, reports greenbaypressgazette.com.
