Conway Community Swimming Pool, Inc. is seeking a permit from the U.S. Army Corps of Engineers, New England District to conduct work in waters of the United States in conjunction with maintaining a pool facility and doing other work in Conway, Mass.
Conway Community Swimming Pool, Inc. is proposing to discharge dredged and/or fill material into waters of the U.S. to repair the pond dam, to remove excess sediment from the pond, and to maintain the bathing beach at the existing in-stream swimming facility in Conway.
The work is proposed in Pumpkin Hollow Brook at 332 Whatley Road in Conway. The purpose of this project is to make repairs to this in-stream facility so that it can be re-opened as a recreational facility. The Conway Community Swimming Pool was damaged during Hurricane Irene. Based upon concerns with the stability of the outlet structure/downstream dam, the pond has been dewatered over the past 1 – 2 years.
As part of this proposal, the applicant also is requesting authorization to conduct regular and recurrent future excavation of accumulated sediment from this pond. This future maintenance work would be conducted during the winter draw down period.
The application for the federal permit was filed by Conway Community Swimming Pool, Inc. with the Corps in compliance with Section 404 of the Clean Water Act, which regulates the discharge or fill of material in U.S. waters, including wetlands.
